About Us

Why choose John W. D’Ewart as your attorney?

Experience and Knowledge

John has dedicated his lengthy career to estate planning, probate and trust administration, probate and trust litigation, and conservatorships; becoming the first currently active attorney in Chico to be certified as a specialist in estate planning, probate and trust law, by The State Bar of California Board of Legal Specialization.

According to the State Bar of California, California attorneys who are certified as specialists – such as John – have taken and passed a written examination in their specialty field, demonstrated a high level of experience in the specialty field, fulfilled ongoing education requirements and been favorably evaluated by other attorneys familiar with their work.

It is important to know your options when it comes to estate planning, as no two clients have the same needs. Because each client has their own particular needs circumstances, we work closely with our clients to ensure that their needs are met through an individualized estate plan using trusts, wills, powers of attorney and advance health care directives to meet their needs.

Unlike most estate planning attorneys, John also litigates cases involving estate planning issues. This extensive depth of experience, along with John’s knowledge and experience as a certified specialist in estate planning, probate and trust law, allows him to craft estate planning instruments designed to avoid potential issues and challenges that can lead to family litigation.

Results

As it relates to estate planning, we offer our clients peace of mind knowing they have done all they can to ensure their affairs are arranged to protect themselves and their loved ones.

Trust litigation becomes necessary when there are disputes concerning the trust administration process, or issues arise concerning a trustee’s actions. If there is a violation regarding the terms of the trust, trustee duties, or misconduct concerning the California Probate Code, then there could be grounds for a dispute which would require trust litigation.

Trust litigation is a highly complex and technical process that requires extensive knowledge and experience to achieve the best desired outcome.

We provide dedicated, diligent, and results-oriented representation to both trustees and beneficiaries in trust disputes, including trust and will contests, claims of undue influence, and capacity issues. We handle a diverse spectrum of difficult issues and work hard in achieving the best possible outcome with minimal stress to our clients.

Compassion and Respect

Many clients come to us during difficult times after the passing of a loved one. John listens to his clients and gives trusted legal advice in order to give peace of mind. John and his office staff treat each client with care and compassion in achieving their legal goals. Each client is treated with respect, dignity and compassion.

Communication and Availability

John and his office staff strive to always make time available for clients. Moreover, unlike some other estate planning attorneys, John will make short-notice, special house calls or hospital calls to meet with his clients when time is of the essence.

Need an Expert Witness?

John has testified as a designated expert witness in Butte, Placer and Solano counties concerning trust administration and the trustee’s role in administering trusts, capacity and undue influence of Settlor of a living trust, standard of care for drafting estate planning documents, and in the interpretation of trust provisions.
